Investigators say Patel doused his sons with gasoline and set them on fire in a shower stall inside their Glendale Heights home. Patel was also injured.
Patel's 4-year-old son, Om, died in January. Seven-year-old Vishv is still hospitalized with severe burns.
The boy's father is charged with first-degree murder attempted murder and aggravated arson. He is scheduled to make his first court appearance tomorrow.
