Prosecutors say alleged gang member Elias Diaz drove the getaway car after the shooting that left 6-year-old Nico Contreras dead in 1996. Diaz is charged with murder.
Tuesday, the leader of Diaz's gang told the judge that when he learned his gang was blamed for Contreras's death, he ordered Diaz to bring the gunmen to him, but Diaz refused.
The alleged triggerman, Mark Downs, is expected to stand trial later this year.
