The federal lawsuit alleges Donald Wells suffered a medical condition just before the crash.
Family members claim officers ignored their pleas that he get medical care during his two days in police custody. They say that contributed to his death from pneumonia and multiple organ failure last June.
The Chicago Tribune reported at the time of the crash that Wells was taken to Stroger Hospital immediately but refused treatment.
