A former teacher acquitted of abuse charges has filed suit against the village of Schaumburg and a detective, accusing them of malicious prosecution. Patrick McCarthy taught special education at Robert Frost Junior High School. In 2007, he was charged with battery and unlawful restraint involving three autistic children in his class.
McCarthy was found not guilty, and the judge suggested authorities overreacted to the situation.
The lawsuit accuses the detective of failing to conduct a reasonable investigation and knowing that McCarthy was innocent. Schaumburg Police Sergeant John Nebl told the Daily Herald he has not seen the suit and could not comment.
