Suspects in officer's death in court

August 19, 2009 (CHICAGO) Officer Alejandro Valadez was shot and killed while responding to reports of gunfire on the South Side in June.

Twenty-year-old Shawn Gaston and 21-year-old Kevin Walker are both charged with first degree murder and several other charges.

The judge in the case has been criticized for releasing Gaston on probation, instead of jail time, for a prior charge of gun possession. But Gaston's attorney said the judge made the right decision.

"The position that people are taking, that somehow if the judge had sentenced him to jail that the officer would be alive today, is a fallacy because that assumes Mr. Gaston's guilt," said Joel Brodsky, defense attorney.

The judge set the next court date for September 25.
