Samantha Tumpach filed the suit Tuesday against Rosemont's Movico theatre.
Tumpach was arrested at the theater in November when she recorded a few minutes of the film for what she called a birthday memory for her sister. The charges were eventually dismissed.
Her suit alleges the theater committed malicious prosecution, intentional infliction of emotional distress and negligence.
