Drew Peterson's defense team is scheduled to return to Will County court Monday to try and have an unlawful weapons charge against him dropped. Peterson's attorney plans to use the recent Supreme Court decision that overturned Chicago's handgun ban in his motion to dismiss.
Peterson was charged with possessing a rifle shorter than the legal length.
Peterson remains behind bars, charged with the murder of his third wife, Kathleen Savio. He's also suspected in the disappearance of his fourth wife, Stacy. He denies any involvement in either case.
