Helen Miller of Lake Villa was injured October 26th when a branch crashed through the window of her Smart car.
The Chicago Tribune reports that miller is suing the Vista Health System Surgery and Treatment Center in Lindenhurst for not properly maintaining the tree.
The branch missed vital organs, but the lawsuit claims that Miller suffered permanent injuries.
A spokesperson for Vista Health System would not comment to the Tribune on the lawsuit.
