$1.8 million settlement in 2003 Metra train derailment

The Kuk family of southwest suburban Plainfield was heading home from the Chicago Marathon on October 12, 2003, when the derailment occurred.

Kathryn, Steven, and Megan Kuk were all hurt. Kathryn Kuk suffered multiple injuries to her lower back.

"It's changed our lives completely," said settlement recipient Steven Kuk. "She can't do the simplest task, shopping, simple things have become very difficult for her."

The family's lawyer says the accident could have been prevented if Metra had "positive train control systems" in place.

Metra tells ABC7 it is fully committed to implementing "positive train control" by the federally mandated deadline of 2015.
