Kustok is accused of killing his wife, Anita Kustok, in September 2010. He maintains his innocence and said his wife committed suicide.
Investigators believe he was having extramarital affairs and wanted a divorce. Prosecutors say they plan to call several women as witnesses who claim they had affairs with Kustok.
Defense attorney Rick Beuke slipped and fell on ice outside the courthouse Thursday morning. He had a cut on elbow that was bleeding, so he excused himself as court opened to go to the hospital.
