Del State Univ. shooting suspect freed

DOVER, Del. (AP) - December 27, 2007

An attorney for Loyer Braden, a former DSU student charged in the shooting death of a fellow student, requested bail modification at a hearing on Dec. 21, Attorney General's Office spokesman Jason Miller said.

Braden, 18, of East Orange, N.J., was charged with second-degree murder after 17-year-old Shalita Middleton of Washington D.C. died from gunshot wounds in October, a little more than a month after the shootings. Another student was wounded in the ankle by gunfire leading to the assault charges.

Braden pleaded not guilty earlier this month.

Braden was being held in lieu of $192,000 cash bail, an amount that more than doubled in October after Middleton died. However, Superior Court Judge Robert Young modified bail last week from cash to secured, meaning Braden only needed to post a percentage of that amount. Braden was released Friday night.

As a condition of his release, Braden must keep daily phone contact with the Delaware Department of Correction until an electronic GPS monitoring device is placed on him.

Miller said the Attorney General's Office opposed the motion. Prosecutors notified the families of the victims of the change after the hearing, he said.

According to investigators, Braden was involved in a fight with another student three days before the shooting, and the two confronted each other again at a campus cafe on the night of the shooting. Middleton was among those who tried to defuse the altercation in the cafe.

Investigators said Braden left the cafe shortly after Middleton's group departed, then began shooting at the group as they walked across campus.

Braden was also indicted on three counts of possession of a firearm during the commission of a felony and single counts of first-degree reckless endangering and first-degree assault. He faces 15 years to life in prison if convicted of the murder charge.

Braden's next court appearance was scheduled for Jan. 15, when his case will be reviewed for the first time.

A spokeswoman for the state Department of Correction and Braden's attorney did not immediately return messages left Thursday night.
