McKaskle, who was the boyfriend of the child's mother, told police Seese fell down the basement steps.
An autopsy found the boy's injuries were caused by physical abuse.
McKaskle who is in jail on an unrelated charge in Nebraska, now faces 2 felony charges in the child's death.
"In the event that he decides to not waive extradition and come here then we will begin proceedings and ask that he be extradited to Lake County Indiana," said Sheriff Roy Dominguez, Lake County, Indiana.
The child's injuries were so severe he was placed on life support but died a few days later.
