Police say he drove onto a sidewalk last month in Batavia and struck a man who was walking his dog.
David Long, 57, died from his injuries.
Police say cook fled the scene on foot but he was later arrested.
Prosecutors say cook stole the car and say he's never had a valid driver's license.
