3 charged in Boston Blackies fraud scheme

The owners of Boston Blackies and a restaurant manager were formally indicted Monday on check-kiting charges.

Nick Giannis, 62, his son Chris, 38, and manager, Andy Bakapoulos, 38, are accused of defrauding at least two banks out of nearly $2 million.

Prosecutors say the three wrote checks from banks where they had accounts with insufficient funds, then deposited those checks in other banks and withdrew the money before the checks cleared.

"The bulk of our defense right now is that my client was in the wrong place, at the wrong time and if anything wrong was going on he was basically unaware of it," said Alexander Memmen, Bakapoulos's attorney.

Nick Giannis remains in custody. He was arrested last month at the Canadian border as he allegedly tried to leave the country.

The Giannis family was a contributor to the campaign of democratic Senate candidate Alexi Giannoulias.
