The owners of the Gatling Chapel on Chicago's South Side and Restvale Cemetery in Alsip have submitted a proposal to acquire Burr Oak.
A judge will decide this week whether to accept the terms of the bid.
Last July, Cook County sheriff's investigators discovered that dozens of graves were dug up and allegedly resold. Four cemetery workers were charged in the scandal.
