The family of a dance instructor killed at a train crossing three months ago has filed suit against the railroads responsible for maintaining the crossing.

Canadian National Railway acknowledged the gates and lights at the University Park crossing were not working correctly when 26-year-old Katie Lunn was struck and killed.

An investigation determined the warning signals had been deactivated during repairs at the time of the crash.

The lawsuit claims negligence by two railroads owned by the Canadian National Railway. The company had no comment on the lawsuit.
