The upgraded charges of murder and neglect of a dependent were filed against Riley Choate and his ex-wife, Kimberly Kubina, Tuesday.
The body of Christian Choate, 13, was found last week under a concrete slab at a Gary, Ind., mobile home park. Police found the body after a call from his sister, Christina Choate, 17. She told The Northwest Indiana Times her father confined the boy to a cage for about a year before he died at 13.
An autopsy report shows the boy died of blunt force trauma.
