The lawsuit alleges Danks refused to call 911 after Blake Papst fell about 10 feet onto a rooftop deck in August 2010.
Papst claims he remained on the deck unable to move for several hours. He says Danks checked his breathing and looked for any blood loss, but never called 911.
Papst's lawyer says he suffered a spinal cord injury and is now a paraplegic as a result of the accident.
