CHICAGO (WLS) -- A now-former deputy commissioner in the Chicago Fire Department was under the influence of alcohol when he crashed a department vehicle, but he is not charged with drunk driving.

Per fire department regulations, John McNicholas performed a breathalyzer test for fire officials shortly after a crash Wednesday morning - but those results can't be used by police.

McNicholas has since retired from the force and been cited for negligent driving.

Police said the investigation continues and more charges could be filed.
