DUI charge thrown out in death of Naperville woman

A DUI charge has been thrown out in connection with the death of a Naperville woman almost four years ago.

NAPERVILLE, Ill. (WLS) -- A DUI charge has been thrown out in connection with the death of a Naperville woman almost four years ago.

A DuPage County judge ruled Friday that prosecutors failed to prove their case against James Kisla of Lisle.

He was charged with DUI after he struck and killed Donna Early after the Lisle fireworks display in July of 2011.

One of Kisla's attorneys is calling for an investigation into the state police crime lab. He claims Kisla's blood was not tested property for an alcohol level.
