Wife charged in Geneva man's death

GENEVA, Ill. (WLS) -- A woman has been charged after her 53-year-old husband was found dead in his home in west suburban Geneva.

Julia Gutierrez, 53, is charged with first-degree murder in the death of Eduardo Gutierrez.

Kane County State's Attorney's Office alleges that sometime between last Tuesday and Thursday, Julia Gutierrez mixed the sedative Temazepam into a drink and gave the drink to Eduardo Gutierrez. Eduardo Gutierrez, unaware of the Temazepam, consumed the drink and died as a result.

Police said someone asked them to do a welfare check at 39 Crissey Avenue around 6:20 p.m. Thursday. Authorities said the caller was not inside the home.

When officers arrived, they found Eduardo Gutierrez dead inside the house.

Police said his wife was also inside the home when police got there. She was given medical attention at the scene and later taken to the hospital to get checked out.

Crime scene technicians spent hours taking pictures and blocking roads in the quiet neighborhood while they executed a search warrant. The Kane County Major Crimes Task Force was called in to help.

"We're not divulging much information in reference to who we have spoken to and who we haven't spoken to. We do feel confident that the public is not in any danger," Nash said Thursday.

Police said the home was not one they had been to frequently in the past.
