The lawsuit claims an Amazon-approved driver, Shawn Akison of Romeoville, was under the influence of fentanyl, speeding, and looking at his phone when he slammed into the bus last year.
The crash happened near U.S. 20 and Fail Road in May 2025. A high school baseball team was the school bus when the crash happened.
Lucas Bradshaw, 16, was thrown from the bus. He suffered a severe traumatic brain injury, spent 54 days in a coma, and is still undergoing therapy.

Lucas' father, who was driving the school bus, was also hurt in the crash.
The lawsuit alleges Amazon ignored years of the driver's traffic violations, license suspensions, and a felony drug arrest just months before the crash.
The driver pleaded guilty to causing catastrophic injury while under the influence of drugs.
He's currently serving an eight-year prison sentence.
Amazon and the driver's employer are both named as defendants.
An Amazon spokesperson released a statement: "This was a tragedy, and our hearts are with the families affected as they recover and the entire LaPorte County community. Given this is active litigation, we have no further comment."
