Eugene McSwain died during a traffic stop last July on Chicago's far south side. Now his family is suing the police and the city.

CHICAGO (WLS) -- Eugene McSwain died during a traffic stop last July on Chicago's far south side. Now his family is suing the police and the city.

The man's father, Eugene McSwain Sr., claims his son was shot in the back of the head, even though he was not armed.

According to police reports, McSwain pointed a gun at police.

The family is suing the officer involved and the city. The family is claiming police helped cover-up the shooting.

"They are covering up so much stuff now it's ridiculous. The people don't have nothing to say about it because when you bring something to them, they take it and shove it up under the table," said Eugene McSwain Sr.

We have not been able to reach the city for comment about this specific lawsuit, but the city usually does not comment on pending litigation.
