Chicago man charged in shooting that killed 10-year-old boy after July 4th gathering in Gary

GARY, Ind. (WLS) -- A 31-year-old man was arrested Sunday in connection with a shooting that killed a 10-year-old boy and seriously injured a 51-year-old man following a Fourth of July gathering, according to authorities in Lake County, Indiana.

Investigators said Ernesto Posadas was arrested Sunday, the same day he allegedly shot and killed Montana Weathers and wounded the 51-year-old man.

The shooting occurred shortly before 1 a.m. Sunday in the 200-block of Chase Street in Gary. Weathers and the injured man were taken to Methodist Northlake Hospital, where Weathers was pronounced dead. The 51-year-old man was later transported to a Chicago-area hospital and remains in critical condition.

Posadas was taken into custody later Sunday by Gary police officers during a traffic stop on Interstate 80/94.

According to a probable cause affidavit, detectives reviewed Ring doorbell footage that allegedly shows Posadas and another man arriving at a home on Chase Street in a black minivan, getting out of the vehicle and opening fire.

Investigators said Posadas had been at the home earlier for a Fourth of July party with his girlfriend before leaving after an argument. Authorities allege that Posadas later returned with another man and that both fired shots toward the front porch, where his girlfriend, Weathers and two other people were located.

According to investigators, Weathers was struck in the head, while the 51-year-old man was shot in the stomach.

Prosecutors said Posadas is classified as a serious violent felon under Indiana law and has a criminal history that includes a 2018 aggravated kidnapping conviction in Cook County.

Posadas is scheduled to appear in court at 8:30 a.m. Wednesday in Crown Point.
