Timberlake, who did not appear Friday, will be re-arraigned on the misdemeanor charges of driving while intoxicated and failing to keep right.
The driver told police three people were inside the car. However, they were all found safe and say they weren't with him.
The woman is also facing charges for a DWI, spitting on a law enforcement officer and having fake IDs, according to police.
This is not 64-year-old Steven Schwally's first DWI incident. He pleaded guilty to similar charges in March 2013.
"If I do this test and don't do well," the judge said. "I lose my career."
