CHICAGO (WLS) -- Some residents are protesting the planned expansion of Lincoln Park Elementary School and hoping a judge will rule in their favor this week.
The group went before the zoning board to challenge the zoning change the school and Chicago Public Schools were granted in order to build the annex, but the appeal was denied.
On Tuesday a judge will decide whether to uphold their temporary restraining order to delay construction.
Residents say the annex would be too close to the street.
"Pull the last 50 building permits issued for additions, I can assure you, you will also find that this is dominated by residential homes with setbacks in excess of 30 feet," said resident David Gaito.
Residents say if their temporary restraining order is removed, they will go to the circuit court for an appeal.
