Jared Fogle prosecutor asks for 12 1/2 year sentence

INDIANAPOLIS (WLS) -- Prosecutors are asking for a sentence of 151 months, or about 12 1/2 years, in prison and a lifetime of supervised release for former Subway spokesman Jared Fogle, who plead guilty to child pornography charges in August.

In a sentencing memo filed Thursday, U.S. Attorney Steven D. DeBrota wrote, "...the Court should impose a sentence of 151 months of imprisonment, followed by a lifetime period of supervised release." Fogle will also have to register as a sex offender in any state where he works or resides.

Fogle faces a mandatory five years in prison after agreeing to plead guilty to charges that he paid for sex with minors and received child pornography. He will also pay a total of $1.4 million in restitution, $100,000 for each of 14 minor victims.

In the memo, DeBrota writes that Fogle did not just commit crimes on his own but also "with a willing and dangerous co-conspirator," Russell Taylor, the former president of Fogle's childhood obesity foundation and producer of some of the child pornography found in Fogle's possession. DeBrota also writes, "it is true that Fogle argues that he is at a low risk to recidivate. However, he is more likely to recidivate than others convicted of non-contact child pornography offenses because of his repeated efforts to obtain and use prostituted minors."

Fogle is scheduled to be sentenced on Nov. 19.
