Family of man killed in Humboldt Park CPD shooting sues police, city: 'They chased an innocent man'

CHICAGO (WLS) -- The family of Derek Jordan spoke publicly Monday after attorneys filed a civil lawsuit against a Chicago police officer and the city of Chicago, alleging the officer used unjustified deadly force in the shooting that killed Jordan.

Relatives of Jordan stood with attorneys as details of the lawsuit were released.

"I am a wreck. He took my baby. I ask you, 'how does that person who killed my son sleep at night?'" mother Christine Thompkins said.

The lawsuit, filed Friday against the city of Chicago and Chicago police Officer Max W. Walzer, alleges that "Walzer fired six shots" and used "unjustified use of Deadly force upon Jordan."

Jordan's father, Derek Thompkins, said, "No one deserves this. No human being deserves this type of treatment here from people that are sworn to serve and protect."

According to police, officers began following a white car on March 9 after it was allegedly linked to a shooting. Police said the vehicle struck a pedestrian, a CTA bus and a police car before an officer opened fire near Homan Avenue and Chicago Avenue in Humboldt Park.

Jordan died in the shooting.

The lawsuit alleges Walzer escalated the situation by threatening Jordan and firing through the passenger-side window 20 seconds after arriving at the scene.

Attorney Antonio Romanucci, who represents Jordan's estate, said, "because the shooting and killing of Derrick Jordan was so outrageous, shocked the conscience of so many, we need the public to see what happened. If they haven't seen it, they must see what happened when Officer Walser arrived on scene."

Jordan's father disputed that his son had committed any crime.

"My son hadn't did anything. I don't know who they were chasing, who they were supposed to be chasing, but my son had not committed any crime at all. They chased an innocent man down and shot him down," Derek Thompkins said.

Christine Thompkins vowed to continue seeking accountability.

"I will get justice for Derrick. I just want justice to be done. I love you, Derrick. Rest in peace, son," she said.

The Chicago Police Department said Officer Walzer remains on active duty. The Civilian Office of Police Accountability continues to investigate the shooting.

A spokesperson for the city said officials would not comment on pending litigation.
