Waukegan woman tries to patent 'I can't breathe' phrase

WAUKEGAN, Ill. (WLS) -- A Waukegan woman is trying to trademark "I can't breathe," the dying last words of Eric Garner.

The words have been a rallying point for protestors since a grand jury failed to indict NYPD Officer Daniel Pantaleo for putting Garner in a chokehold.

Bulls star Derrick Rose and the Cavaliers' Lebron James have already worn t-shirts with the phrase.

In a Dec. 13 application, Catherine Crump petitioned the United States Patent and Trademark Office to register the phrase for use on hoodies and t-shirts for men, women, boys, girls and infants.
