MCHENRY, Ill. (WLS) -- The family of a woman killed in a Fox River boat crash has filed a wrongful death lawsuit.
Magdalena Jablonska was a U.S. Marine veteran. Her fiancé survived the boat collision and is still recovering.
He's expected to speak Thursday morning, as her family files a wrongful death lawsuit.
The lawsuit claims that on July 25, Jablonska was sitting next to her fiancé on their boat, when a speeding boat flew over them, decapitating Jablonska and seriously injuring her fiancé.
Richard Stevenson is charged in the crash and accused of having a blood alcohol level more than twice the legal limit.
Security video from a nearby home appears to show the pontoon Stevenson was driving.
The lawsuit alleges he was driving more than 75 miles-per-hour, as he approached a no-wake zone on the Fox River where the crash happened.
Jablonska was from Des Plaines and served as treasurer of a local chapter of the Women's Marines Association.
The man charged is due back in court later this month.
