The mother said the school called her Thursday morning and said her son was participating in inappropriate behavior. She said the official said her son would be suspended, and that it was all caught on tape.
The victim's mother said she went to the school and watched the tape with the school's assistant principal, who was also viewing it for the first time, according to the mother.
"I see my son sitting at a desk, and I see two other little boys sitting at a different desk, and one little boy goes under the desk, in between my sons legs, pulls his pants down," the victim's mother said. "He told him to stop."
She said she watched as a 6-year-old boy allegedly performed sex acts on her son and another boy for more than 20 minutes. After viewing the tape she was referred to the principal, who wasn't available at that time.
The mother showed ABC7 a copy of a report from taking her son to the school nurse. In that report, the nurse writes the victim told her "He held my hands and pulled my pants down."
The victim's mother said the teacher was "in the classroom" while the incident happened.
"From my knowledge, with what I was watching, she wasn't paying them any attention," she said.
She said she is frustrated with how the school is handling the situation.
"The school hasn't contacted me at all yet, like for anything," she said. "Like nothing ever happened."
The woman said she took her son to the hospital and called police. The Gary Police Department confirmed it is investigating the incident, but didn't say whether or not detectives had seen the tape.
After the story aired at 6 p.m., Principal Chris Evans called ABC7. He said he met with the victim's mother and a Gary police detective on Friday. He said he has reviewed the tape and did not see a child pulling down another boy's pants. He also said the tape lasted about three minutes.
Evans also said the victim's mother told him she "trusted their handling of things and her son would be back in class on Monday."
However, the victim's mother maintains her story and said she already has transfer papers to send her son to another school and plans to file suit.
