CHICAGO (WLS) -- Three Chicago police officers are facing a lawsuit, accused of assaulting two men after a night of drinking.
The two brothers were beaten, according to their lawyer. One had a broken nose, a lawsuit alleges, and the other had visible facial injuries.
Photos shows Javier Jimenez's face bruised and swollen. His attorney says it was because three off-duty Chicago police officers beat him on a sidewalk last January. The alleged beating happened outside the Golden Nugget restaurant in the 4200-block of W. Irving Park Rd.
Two brothers had left Joe E's Bar nearby when, according to their lawyer, three off-duty cops attacked them.
This lawsuit filed Tuesday alleges Scott Rooney, Joshua Almodovar and Jesus Delgado assaulted brothers Javier and Juan Jimenez.
The suit claims that in a police report obtained by the Jimenez's attorney, a responding officer said the accused cops smelled like alcohol and "all three stated that they had been drinking."
One witness also said, according to the lawsuit, he was going to call the police, when another officer remarked quote "we are the police".
The police report included in Jimenez's lawsuit indicates the brothers first encountered the officers inside a bar, and several words were exchanged, including alleged gang ties and cop killers.
Jimenez's lawyer said IPRA has not ruled on the investigation and he believes the officers were never disciplined.
