Judge Johnson denied a defense motion for a new trial. He also denied a defense request to reduce Jassy's second-degree murder conviction to manslaughter.
Prosecutors say the victim, John Osnes, 55, banged on the hood of Jassy's rented sport utility vehicle after it nearly struck him in a Hollywood crosswalk. Osnes was a jazz pianist and pedestrian activist. They say Jassy got out, punched Osnes in the face, and then gave him a brutal kick in the head as he bent to pick up his glasses. Osnes fell to the ground. Prosecutors say Jassy ran over Osnes as he drove away.
A jury found Jassy guilty of second-degree murder, assault by means likely to produce great bodily injury, and battery with serious bodily injury.
