The Illinois attorney general's office is now prosecuting the case of a Lake County judge accused of DUI. But all parties are waiting to find out which judge will hear the case.

Judge David Hall was Lake County's chief judge until this week.

He was arrested in Vernon Hills Saturday and charged with DUI and interfering with police.

Hall says he was pepper-sprayed by an officer during the traffic stop. The Illinois Supreme Court is now trying to assign a judge from outside Lake and McHenry counties to hear the case.
