Cook Co. Commissioner Tony Peraica, in a battle to retain his west suburban seat, filed a federal wrongful arrest lawsuit against police and officials in McCook -- home turf to chief rival Jeff Tobolski, who is mayor of the tiny village.

The always outspoken and frequently controversial Peraica was arrested Saturday and charged with criminal damage to property for allegedly destroying Tobolski signs. He told the Sun-Times "the whole thing is a set up."

But Tobolski, the Democratic candidate, said there is no conspiracy here: "He got caught and he was identified by a witness. He can file all the lawsuits he wants."
