Investigators say Rousso had inhaled fumes from a cleaning product before driving onto a sidewalk, striking and killing 5-year old Jaclyn Santos Sacramento, on Labor Day.
The Chicago Tribune reports that a judge has sealed evidence in the case.
Rousso also faces a civil lawsuit.
