The family of Phyllis Barnes filed the wrongful death suit against Weinberger and another doctor. Barnes died in 2004 from throat cancer shortly after nose surgery.
The lawsuit claims Weinberger was negligent when he missed her throat cancer.
Weinberger has already pleaded guilty in a separate criminal case.
The doctor, who spent five years on the run, was captured in 2009 camping out in the Italian Alps.
