The Chicago Tribune says there was a private meeting last week with lawyers in the case and Judge James Zagel.
The judge was reportedly leaning toward a January trial date, so jurors would not miss the holidays. If Blagojevich is out of money, two defense attorneys could be appointed for him at taxpayer's expense.
Last week a jury convicted Blagojevich of lying to federal agents but deadlocked on the 23 other counts.
