Boy shot himself with employee's gun, father says

The father of a 4-year-old boy who accidentally shot himself to death in a store is suing an employee there.

On July 21, Ash Wimberley shot himself in the head at Tubby's Wine and Spirits in suburban Beecher.

The lawsuit claims the gun belonged to a worker who left the weapon loaded and unlocked where the boy has access to it.

Police say charges were never filed in the incident.

We were unable to reach the store or the store's employee for a comment on the suit.
