Burris has been under scrutiny since he was appointed to Barack Obama's former seat by Rod Blagojevich when he was the state's governor.
Durbin also said he met with Sangamon County state's attorney John Schmidt last week. He says Schmidt is reviewing Burris' testimony before the Illinois House Impeachment Panel to determine whether criminal charges are warranted.
