A judge Wednesday threw out the two most serious sexual abuse and sexual assault charges against former Aurora gymnastics coach Michael Cardamone.

DuPage County Judge Blanche Fawell says vindictiveness was involved in the prosecution on those counts.

Cardamone was convicted in 2005 on charges he improperly touched girls at his family's gym.

Those sexual assault charges were eventually overturned by an appellate court, and a new trial was ordered.

Even with Wednesday's ruling, Cardamone still faces a retrial next spring.
