The mother of 2-year-old Abigail Holland filed a wrongful death lawsuit in Will County Thursday.
Tiffany Lynn Holland is suing Tracy and Michael Kennedy for $50,000.
Prosecutors say Kennedy had been watching the toddler at her Aurora home last August when Abigail drowned in the above ground pool.
Kennedy has been charged with endangering the life of a child and faces up to 10 years in prison if convicted.
