Officer William Cozzi allegedly hit a man who was handcuffed to a wheelchair. The attack happened in August 2005 at Norwegian American Hospital.
A federal grand jury has indicted Cozzi for violating the man's civil rights. He has already pleaded guilty to a state charge of battery.
A police spokesperson said Thursday Cozzi remains suspended from his job without pay.
