Brian Warren's relatives say they called the medical examiner's office to check if his body had been recovered after he disappeared last December. But a morgue employee claimed they did not have the body when the body was there.
The suit also claims Warren was taken to Saint Bernard Hospital after he was found. But his family was not notified when he died there.
ABC7 was unable to reach the hospital of Cook County for a comment.
