ABC7 news partner The Daily Herald reports 50-year-old David Hatyina was convicted of a DUI in 1996.
He is now accused of having alcohol and cocaine in his system when the boat he was operating struck 10-year-old Tony Borcia on July 28. The boy had been riding on an inner tube.
Prosecutors sought to increase his bond Thursday morning, but Hatyina remains free after posting 10-percent of $1 million bail.
