NW Ind. truck driver gets new trial

August 3, 2009 A jury found 26-year old Michael Kozlowski of Schererville guilty of using a trucking log that contained false entries.

A judge granted a new trial after ruling that the conviction was based on a loose interpretation of the federal statue's wording.

In October of 2005, Kozlowski fell asleep at the wheel and overturned his semi truck on I-94 West of Osseo, Wisconsin, which is south of Eau Claire. A bus carrying a high school band hit the truck, killing five people and injuring 28 others.
